| 内容記述 | 「建物の区分所有等に関する法律」（以下：「区分所有法」）第70条は、一定の要件を満たした場合、いわゆる団地管理組合の集会において団地内の全建物を一括して取り壊し新たな建物を再建できる旨定めているが、この定めが憲法29条に違反すると主張されていたところ、最高裁は、規制の目的、必要性、内容、規制によって制限される財産権の種類、性質及び制限の程度等を比較考量し判断すれば、同条は憲法29条には違反しないものとした事例。 | |||||||

| 内容記述 | This paper provides a case study analysis and review on the case in which the Supreme Court overruled the claim that Article 70 of the Apartment Ownership law-the law states that demolition of all existing buildings and reconstruction of new buildings in the housing complex are allowed when agreed at the "Meeting", and if certain requirements are met - violates Article 29 of the Constitution, stating that weighing the purpose, necessity, content of these regulations, the type and nature of property rights that is limited by them, and the level of limitations, Article 70 does not violate the Constitution. | |||||||
